Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Zettler.host (“Zettler”, “we”, “us”, or “our”), a zero‑trust, end‑to‑end encrypted file hosting service. By accessing or using Zettler.host, you agree to be bound by these Terms.

1. Service description

Zettler.host provides secure upload, storage, and sharing of files with client‑side encryption, password‑protected links, expiring and revocable access, audit logs, and developer APIs. Our zero‑trust design ensures we cannot access file plaintext when you enable end‑to‑end encryption (“E2EE”).

2. Accounts and eligibility

  • You must be at least 16 years old (or older if your local law requires) to use the Service.
  • You are responsible for safeguarding your account credentials and any device or recovery methods you use.
  • Teams may invite users subject to applicable seat limits, roles, and policies set by the team owner/admin.

3. Your content

  • You retain all rights to files you upload (“Content”). We do not claim ownership.
  • You grant us a limited, revocable license to store and transmit encrypted Content solely to provide the Service.
  • You are responsible for ensuring you have all necessary rights and permissions to upload and share Content.

4. Prohibited use

You agree not to use the Service to:

  • Violate any law or third‑party rights (including copyright and privacy).
  • Upload malicious code or attempt to disrupt, probe, or gain unauthorized access to systems.
  • Store or distribute illegal content, exploitative material, or content that causes harm.
  • Circumvent technical or rate limits, or abuse public links and bandwidth.

5. Security and encryption

  • With E2EE enabled, files are encrypted client‑side before upload. We store ciphertext and metadata.
  • Per‑file keys may be wrapped with account keys and optional link passwords. We cannot decrypt without proper keys.
  • Some features (e.g., malware scanning, content transformations, previews) may require server‑side processing. If enabled, we will clearly indicate the scope and safeguards.
  • You are responsible for key management where customer‑managed keys or self‑custody is enabled. Loss of keys may render Content permanently inaccessible.

6. Data residency and compliance

We offer regional hosting options (e.g., US/EU) and enterprise controls such as SSO, RBAC, SCIM, audit exports, and optional customer‑managed keys. We maintain controls aligned with SOC 2 and support GDPR/CCPA compliance. See our Privacy Policy for details.

7. Fair use and bandwidth

Plans include limits on storage, bandwidth, requests, and link usage. We may apply rate limits or require plan changes if usage materially exceeds plan quotas or degrades Service stability.

8. Payment and subscriptions

  • Fees, billing cycles, and taxes are disclosed at checkout or in your order form.
  • Subscriptions auto‑renew unless canceled. Cancellations take effect at the end of the current term.
  • Refunds are provided where required by law or as stated in plan‑specific terms.

9. Intellectual property

Zettler trademarks, logos, software, and documentation are owned by us or our licensors. These Terms do not grant you rights to our IP except as necessary to use the Service.

10. Third‑party services

Integrations (e.g., SSO, storage, analytics for operational telemetry) are provided “as is”. Use of third‑party services is governed by their terms and policies.

11. Termination

  • You may stop using the Service at any time and delete your account or Content subject to legal holds.
  • We may suspend or terminate access for violations, non‑payment, or risks to security or operations.
  • Upon termination, we may delete stored Content after a reasonable period unless required to retain by law or at your written request for export (where feasible).

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. NO SECURITY CONTROL IS PERFECT; YOU ARE RESPONSIBLE FOR APPROPRIATE CONFIGURATION, ACCESS POLICIES, AND KEY MANAGEMENT.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZETTLER AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE. OUR AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM (OR $100 IF NO PAYMENTS WERE MADE).

14. Indemnification

You will defend, indemnify, and hold harmless Zettler from claims arising out of your Content or your breach of these Terms or applicable laws.

15. Changes to the Service or Terms

We may update the Service and these Terms. If changes are material, we will provide reasonable notice (e.g., in‑app or email). Continued use after the effective date constitutes acceptance.

16. Governing law and disputes

These Terms are governed by the laws of your contracting entity’s jurisdiction, without regard to conflict of law rules. Disputes will be resolved in the courts located in that jurisdiction, unless otherwise agreed in an enterprise agreement.
